After nearly five months of pre-trial and trial proceedings, our trial team prevailed as the jury returned an 11–1 defense verdict in favor of Foley Mansfield’s client, Dal-Tile, rejecting the plaintiffs’ claims of product defect and negligence. NEW YORK, May 13, 2025 — Foley Mansfield is pleased to announce that a team from the firm’s New York office has obtained summary judgment in favor of a municipality in a personal injury lawsuit. After hearing oral arguments, the Supreme Court of New York dismissed the complaint and all cross-claims against the municipality and issued a written decision finding that the municipality demonstrated that “they did not have prior written notice” of the defect Plaintiff alleged caused her physical injuries. Meihn from Foley & Mansfield’s Michigan office successfully defended a construction defect lawsuit brought against our client and prevailed on a counterclaim for damages regarding repairs. The trial was held in Genesee County. Michigan Department of Education-Violation of IDEA and “Child Find" Greg successfully defended an administrative charge filed by a parent against a Detroit Charter school for allegedly violating IDEA and “Child Find.”  It was alleged that the School failed to provide special education services to the child.  The charge was dismissed by the Administrative Law Judge finding that the school had complied with IDEA and “Child Find” and that any deficiencies were the result of the parents failure to participate in scheduled IEPs and related programs.
