Joseph A. Falk, a Partner in Foley Mansfield’s Chicago office, focuses his practice in toxic tort and product liability, nursing home/long-term care defense, medical malpractice, and commercial litigation.

Joe has extensive experience in case management and development, discovery, drafting motions, taking depositions, trial preparation, and oral argument. He has defended product manufacturers, contractors, premises owners, and other business entities in hundreds of asbestos cases, frequently obtaining dismissals and favorable settlements on behalf of clients. He has successfully arbitrated commercial disputes for his clients, resulting in six-figure judgments on their behalf. Joe’s civil litigation experience also includes the defense of construction matters and a broad variety of personal injury cases.

Recently, Joe obtained a complete defense verdict in a bench trial on behalf of a nursing home where the Plaintiff, who sought $2m in closing, alleged that the Decedent passed away due to a medication error.

Pro Bono

  • Joe defended an individual convicted of a double homicide as a juvenile in the 1990s in his resentencing hearing, after the statute under which he was convicted was declared unconstitutional as applied to juveniles.
  • In 2018, Joe represented an individual on a pro bono basis in a stalking case, successfully arguing that the petitioner’s motion to enter a stalking no contact order was meritless, and the client was in actuality the victim of online bullying by the petitioner. The judge agreed and dismissed the case in the client’s favor.
