Carol Tempesta defends small companies to Fortune 500 companies in toxic tort litigation, including asbestos and talc. She has more than two decades of experience in complex litigation, managing all aspects of a case from inception to resolution. Carol also has product liability experience with Benzene and PCBs, as well as premises liability experience. Additionally, she has several general liability clients for whom she handles personal injury and property damage claims.
Clients seek Carol’s assistance in defending these claims because she is well-versed in conducting and defending depositions, preparing expert witnesses for trial, negotiating settlements, and has experience trying cases in New York State.
Before her career in legal, Carol worked as an industrial hygienist in the aerospace industry, where she performed air quality, noise, and radiation monitoring for military defense contractors and trained employees on the topics of hazardous communications, respirators, noise, and ergonomics. In that role, she also implemented an ozone-depleting chemical replacement program, assisted in stormwater and wastewater programs, and oversaw asbestos abatement projects.
She has been successful in having many matters dismissed at the summary judgment level and has participated as a second chair trial attorney in New York City asbestos trials.
