BIOGRAPHY

Whitney D. Seltzer is an experienced defense litigator who focuses her practice on complex product liability, toxic tort, wrongful death, and personal injury litigation in state and federal court. Well versed in high stakes, sophisticated litigation, Whitney represents prominent national and international corporations in a range of industries, including premises owners, contractors, and manufacturers and distributors of consumer and intermediary goods and equipment in the industrial, chemical, automotive, and construction markets. Whitney likewise has extensive experience as both local and national counsel for several manufacturers of cosmetic products in the emerging talcum powder litigation.

Companies seek Whitney’s counsel in devising innovative and creative defense tactics to meet their immediate legal needs while advancing their long-term business goals. She is experienced in advising and implementing strategy to assist clients with managing their risks arising in multi-jurisdictional, high-volume litigation.

Before joining Foley Mansfield, Whitney practiced at another leading New York defense firm specializing in complex product liability and toxic tort litigation. Previously, Whitney served as an in-house supervising attorney for a livery and commercial automotive insurer, where she determined defense strategy and directed allocation of resources for hundreds of arbitrations per month.

As national coordinating counsel for several clients, Whitney has overseen discovery matters across the United States and crafted comprehensive defense strategies, from pre-discovery phase through trial, for a nation-wide docket.

In a 2021 victory for one of Foley’s national clients, Whitney directed the local counsel team in securing summary judgment, with the court agreeing that the plaintiff failed to put forward sufficient evidence supporting her allegations that the client’s cosmetic talcum powder product was contaminated with asbestos such that it caused her mesothelioma.

Whitney was also part of the 2019 trial team that obtained a directed verdict in favor of a Fortune 500 company at the close of the plaintiff’s case, in which she claimed that the company’s cosmetic talcum powder product caused her mesothelioma.
