- General Negligence: Defense verdict on behalf of mechanical services contractor in a severe construction accident case in Northern California in which Plaintiff sued the general contractor as a result of injuries sustained while working on a construction site. The general contractor in turn sued Foley & Mansfield’s client, a subcontractor, on a cross-claim. Importantly, pursuant to the contract, if the jury found Foley & Mansfield’s client’s even 1% at fault, the client would have been responsible for the entire verdict. After a four-week trial, the jury awarded the plaintiff over $2.6 million dollars in damages, finding that the general contractor was 100% liable for plaintiff’s injuries and that Foley & Mansfield’s client was not negligent in any respect. As a result of post trial motions, Foley & Mansfield’s client was awarded over $300,000 in attorneys fees and costs by the Court.
- Products Liability: Member of trial team that successfully defended Colgate-Palmolive Company in product liability jury trial against claims relating to the company's talcum products. Plaintiff, a 38-year old woman who contracted mesothelioma, sued defendant Colgate-Palmolive, claiming that a talcum powder product, Cashmere Bouquet, had been contaminated by asbestos and lead to her disease. Following a three week trial, and hearing testimony from eight different expert witnesses for both sides, the jury agreed that the Colgate product was not contaminated with asbestos and that Colgate’s product did not cause her disease.
- Premises Liability: Defense verdict/Non-Suit on behalf of timber company in a case where Plaintiffs alleged that the Decedent developed lung cancer as a result of “take home exposure” from the facility at issue. The trial court’s decision was unanimously affirmed on appeal by the Second Appellate District following oral argument.
- Trucking/Transportation: Following a three week trial in a trucking accident where plaintiff alleged permanent injury and disfigurement following impact with a building as a result of the alleged negligent actions of Foley and Mansfield’s trucking client, plaintiff was assessed 50% comparative fault and awarded a total of damages well below his medical damages alone.
