Managing Partner


Joseph V. Macha, a partner in Foley Mansfield's Indianapolis office, relocated from Los Angeles to open the firm's first Indiana office to expand and enhance capabilities for clients in the region. Joe focuses his practice in civil litigation, including product liability, toxic torts, construction defects, environmental law and drug and medical device litigation. He also has substantial experience in healthcare claims and matters, professional liability and commercial trucking.

Joe has served as first chair in more than 20 jury trials to verdict in State and Federal Courts throughout California and other states, in addition to dozens of bench trials and both binding and non-binding arbitrations.

Joe is a member of the American Board of Trial Advocacy (ABOTA), an invitation-only national association requiring extensive civil jury trial experience and an honorable reputation among peers and the judiciary. He is also an NBTA Board Certified Trial Specialist – one of only 100 lawyers in California and one of less than 2,000 in the United States – to hold this certification. Likewise, he is one of only 66 California lawyers to be NBTA Board Certified in Pre-Trial Practice.

Joe's professional background as a chemist has allowed him to develop a particular proficiency in technical, scientific, and medical matters, including issues related to toxic exposure and their sequelae. He has substantial experience in the defense of toxic exposure and environmental claims on behalf of numerous Fortune 500 and Fortune 100 companies, and has spent nearly 20 years litigating claims involving benzene, silica, asbestosis, "mixed dust", metals, ammonia, and exhaust fumes as well as food and water borne illnesses related to Legionella bacteria, salmonella and botulism.  

In relation to environmental cases, he has represented clients both before environmental regulatory agencies and in litigation on matters that fall under state and federal laws, including the Clean Water Act, Clean Air Act, Resource Conservation and Recovery Act (RCRA) and CERCLA.  

Joe has also defended numerous product liability claims, ranging from drugs and medical devices to heavy equipment. In the medical arena, he has defended cases arising out of product defect and failure to warn allegations involving respirators, angioplasty devices, surgical implants and instruments, stents, RF ablation devices, cardiac devices, microcatheters, cardiovascular surgical adhesives, retinal implants, tissue processing, orthopedic stabilization devices, pedicle screws, infusion pumps, surgical electrodes, wheelchairs, gurneys, and centrifuges. These claims, venued in both State and Federal Courts and ranging from two party litigation to Mass Tort, Class Action and Multi-District Litigation (MDL), have involved serious injury including death, stroke, neurological deficits, fatal hypoglycemia, fatal respiratory failure, skin necrosis/Stevens Johnson syndrome, perforation of vital organs, RSD, and extensive debilitating orthopedic injuries. He has also handled the defense of litigation involving numerous pharmaceuticals and dietary supplements ranging from Fen-Phen to Tylenol.

Similarly, his broad experience in the product liability arena includes defending cases throughout the state involving scissorlifts, cherry pickers, jackhammers and power actuated drivers. He has likewise litigated matters involving numerous other types of heavy machinery, hand operated tools, and a wide variety of consumer goods and components including, but not limited to, automobiles, motorcycles, toys, infant car seats, sports equipment and household items.

Joe began his career working in-house for CNA Insurance, where he litigated a variety of matters involving personal lines, commercial lines and professional liability cases, including defending numerous physicians, practice groups, hospitals and health facilities against claims of medical negligence. As a consequence of aggressive file handling, he was specifically chosen to defend SIU (fraud) cases. Later in his career, Joe defended a large number of high profile SIU cases for Infinity Insurance and Coast National Insurance.

Joe has also tried a number of commercial vehicle matters involving both tractor/trailer combinations (long and short haul) as well as public and private transit buses. Due to his familiarity with commercial vehicles, Joe has presented seminars to both employers and carriers on issues of DOT regulations, Federal Motor Carrier Safety Regulations and California Vehicle Code Compliance.

Joe has served as Judge Pro Tem for the Los Angeles Superior Courts and spent years acting as an arbitrator in Los Angeles County.


Successfully defended a client in the Rocketdyne Superfund Litigation and has been actively involved in similar litigation since the 1990s.   Defense in Del Amo/Carson Superfund site and Fresno Water District in breach of flood channels during heavy rain causing chemical and floodwater contamination to multiple residential tracts in Merced area.   Defense of multi-million dollar environmental clean up claims in Santa Fe Springs, Omega Superfund, REV 973 (10,000 + PRPS), and Lomita.
