Michigan Court of Appeals Affirmed Washtenaw Circuit Court’s in Workers’ Compensation Case

On January 20, 2009, the Michigan Court of Appeals affirmed the Washtenaw Circuit Court’s granting of defendant’s motion for summary disposition. Plaintiff had filed a worker’s compensation retaliation, ADA, and wrongful termination claim. Plaintiff claimed that she was terminated from her position because she had previously filed worker’s compensation claims and because she was disabled. The Washtenaw Circuit Court dismissed all claims pursuant to MCR 2.116(C)(10). Plaintiff then filed her appeal as to the dismissal of the worker’s compensation retaliation claim, only. The Michigan Court of Appeals affirmed the Washtenaw Circuit Court’s decision finding that Plaintiff was terminated because she had exhausted all available leave and that she was unable to perform her job functions.
