Foley & Mansfield Wins Summary Judgment in Construction Case

The District Court in Scott County, Minnesota, recently granted our client, a construction company, summary judgment. The Plaintiff alleged that our client, a corporation formerly owned by the Plaintiff, constructed his home with various defects and sued for breach of contract, negligence, and various statutory claims.

The Plaintiff also asserted that our client was the general contractor responsible for the construction of the home. The Court dismissed all of the Plaintiff’s claims against our client.

The Judge concluded that the Plaintiff was the only person responsible for selecting and supervising subcontractors and designing the home, and that there was no reliable evidence of a contract between the Plaintiff and our client. Therefore, our client owed no duty to the Plaintiff and there was no cause of action for breach of statutory warranties.
