Attorney Ebony Morris Hughes of Foley Mansfield’s New Orleans office successfully secured a dismissal with prejudice in a Louisiana workers’ compensation matter.
The claim was initially filed in the wrong court, and the client was untimely served with the suit. In response, Ebony filed a peremptory exception of prescription, arguing that prescription was not interrupted against the client because the claim was filed in a Louisiana court that lacked subject matter jurisdiction, and the suit was not served within the one-year prescriptive period in accordance with Louisiana law.
After a review of the briefs, evidence presented, and oral argument, the Judge dismissed the case with prejudice and at the claimants’ cost.
