David Jaffe Achieves Not Guilty Verdict for OUI Client
David Jaffe, Of Counsel in Foley Mansfield’s Denver office, recently secured a not guilty verdict for a client charged with Operating Under the Influence (OUI), prosecuted by the Essex County District Attorney’s Office. The case involved serious allegations: police claimed the client was driving on the wrong side of the road, exhibited visible signs of intoxication, and engaged in belligerent behavior during the arrest, booking process, and a subsequent visit to the hospital. The prosecution supported its case with testimony from multiple officers, along with a booking video montage presented to the jury.
Despite this evidence, David’s skillful cross-examination elicited enough inconsistent testimony from two separate officers to bring their credibility into question. Additionally, he also introduced medical records that included exculpatory details supporting reasonable doubt.
