California Talc Litigation Team Victorious in ID Motion for Summary Judgment
A Foley Mansfield California Talc Litigation team consisting of Laila Rahimi-Keshari (Partner) and Nicole Brown-Yuen (Partner) successfully prepared and argued a highly contested ID Motion for Summary Judgment before the Superior Court of California, County of Los Angeles. The issue before the Court was whether the Plaintiffs had provided sufficient evidence to support alleged exposure to a so-called asbestos-contaminated talcum powder product. Foley Mansfield argued on behalf of the manufacturer and presented issues of misidentification, lack of diligence in discovery by Plaintiffs and, ultimately, lack of alleged exposure. The Los Angeles Superior Court granted Foley Mansfield’s Motion for Summary Judgment on behalf of the manufacturer. In this ruling, it was confirmed that talc, in fact, is not asbestos and that mere allegations of exposures to talcum powder products are insufficient to sustain claims for asbestos exposures. This victory underscores the importance of being diligent in discovery, strategic in deposition positioning and outpacing oral arguments made by plaintiffs’ attorneys.
