Greg Meihn Wins at Michigan Court of Appeals

     Foley & Mansfield Detroit attorney Gregory M. Meihn, representing an automotive dealership, recently won a Motion to Overturn an Arbitration Award granting Plaintiff attorneys fees in the amount of $294,000 in an Elliott Larsen Civil Rights and Title VII sexual discrimination case. Not only did the Tuscola Circuit Court reverse the award of attorney’s fees to the Plaintiff, requiring him to acquire his fees from Plaintiff’s damage award of $168,000, but the Circuit Court determined that the defendant automotive dealership was entitled to an award of attorneys’ fees for prevailing on the Title VII claims. The issue of awarding attorney fees to a prevailing defendant is a case of first impression in Michigan. Unsure of her appellate rights, the Plaintiff filed a “claim of appeal” and a “leave to appeal” with the Michigan Court of Appeals, both of which were denied.
