Virginia Easley Johnson, Managing Partner of the Miami office of Foley & Mansfield and Andrew Constantine, II, partner in the law firm of Maron Marvel Bradley & Anderson in Jersey City, NJ, successfully defended Georgia Pacific Corp in a trial in Miami-Dade County, Florida that ended on December 5, 2007. The case involved a living 72 year old woman who was diagnosed with pleural mesothelioma. She and her husband are retired school teachers, having taught for 30 years in rural Ohio. Joyce Windnagle claimed exposure to asbestos-containing joint compound in 1968 and 1970 during home renovations.

Attorneys Gary D. Sharp (Detroit) and Jennifer McCormick (San Francisco) successfully defended Calaveras Asbestos, Ltd. with the jury returning a defense verdict after a month-long trial in San Francisco Superior Court.

Berger Teaches Property Law Course
Jana Berger, an attorney in Foley & Mansfield’s Toxic Tort & Mass Litigation practice, recently completed her first term as an adjunct professor with DePaul University in Chicago, IL. Jana taught a Property Law undergraduate online course. DePaul University is the ninth-largest private, not-for-profit university in the nation. Among those 10, all except DePaul are classified as "research extensive" universities, making DePaul the nation's largest university with a primary mission of teaching and service.

Resolution by Mississippi Supreme Court Acknowledges Foley & Mansfield for Assistance to Lawyers in the Aftermath of Hurricane Katrina.
The Supreme Court of Mississippi acknowledged the generosity of the Minnesota State Bar Association and the law firm of Foley & Mansfield, PLLP in a unanimous Resolution on June 20, 2006. In August of 2005, the staff & partners of Foley & Mansfield contributed $100,000 to assist Mississippi lawyers in coping with the damage caused by Hurricane Katrina. Foley & Mansfield also offered use of its Minneapolis office space to New Orleans area law firms whose offices were severely damaged by the hurricane.

Minnesota Court of Appeals Rules that Jury Must Decide Liability of a Licensed Day Care Helper in Wrongful Death Lawsuit - Cindy Bartell, Heather Neubauer, the Minnesota Court of Appeals reversed a lower court’s decision by holding that a jury must decide whether a helper in a licensed day care is liable for the death of infant Hannah Laska, who died of Sudden Infant Death Syndrome at the day care. - Full Story

Blazina and Neubauer named Up-and-Coming Attorneys -
Minnesota Lawyer has recognized Foley & Mansfield attorneys Megan Blazina and Heather Neubauer as Up-and-Coming Attorneys for 2005.

This year they awarded the designation to 15 attorneys in the state of Minnesota, all of whom were admitted to the bar within the past six years. The honorees were nominated by colleagues, bar associations, law schools, judges, and other members of the legal community, and selected by editors of Minnesota Lawyer. Selection criteria included professional accomplishments, significant involvement in the bar or community, taking on a leadership position, excellence in in-house legal services and/or demonstrating great promise. Minnesota Lawyer will host a dinner/reception for the honorees on May 25 at The University of St. Thomas School of Law.

Injured Lion-hunter’s Suit Dismissed - A lawsuit that made headlines around the world has been dismissed. In 2000, a professional big-game hunter was injured by a lion that was shot in the paw and shoulder. In 2003, the hunter sued a bullet manufacturer represented by Bill LeMire of Foley & Mansfield. Jury Rules in Favor of Kelly-Moore Paint Company - A jury in the Los Angeles County Superior Court ruled Wednesday, June 16, in favor of Kelly-Moore Paint Company in an asbestos-exposure lung cancer claim brought by Ernesto and Maria Escamilla. The jury found that Kelly-Moore’s joint-compound produced in 1960-1978 was not defective, and that Kelly-Moore did not “fail to warn” and was not negligent. - Full story
